First a note to the person(s) authoring recent highly irate drive by emails, expressing their opinion that there was no possibility this would come up again…. because the US Government was too busy instituting Socialistic take overs of private corporations…

Truth is, I kept hoping you were right – but here we go again.

Then best you get ready to defend them… Again

I know many of us have been working on effecting the final form of the CPSIA legislation, but it looks like we will soon be back on the front lines of “Orphan Works Opposition”

This writer has been on target before, so fasten your seatbelts.


Please remember – the best way to reach your congressional representatives & senators
is to call AND write to their district offices. Mail to the Capitol is often delayed because of security concerns.

The “ranking” of response is:

Telegram (costs money)

Letter (costs nominal funds, but time)

Telephone calls (make them frequently and be sure to say you are a voter in their district. if you work from home like me, put the number on speed dial, and call every day.
Ask, if they got your letter, Ask if the Congress Critter has read it.

Email is almost useless. Unless you have a real email for the proper staff person, it may not even be read. Of course, filling up their email box has been known to get their attention

Orphan Works Action Needed TODAY FRI October 3

Even if you called before, please do so again today.

As most of you are aware, certain mega business interests have been trying to hide behind a bill supposedly meant to protect Libraries, museums, and educational research.

IF THESE BILLS DID ONLY THAT, then NONE of the members of more than 70 groups would continue to oppose the pending legislation.

Now, we are once again “up against it”

For the last 36 hours, after repeatedly assuring us that the bill would NOT be considered, apparently we have been deliberately misled

Undoubtedly you will be told that no action is planned but we have been told that before and it is ONLY by active participation of the Artistic community we were able to keep this off the floor UNTIL NOW.

Joanne Fink is the “Chair” of the OWOH group so I will let her explain (below) what we need to do.

However, I would ADD, when you call Congress members office,

You NEED to tell this THIS IS ABOUT YOUR LIVELIHOOD or the livelihood fo folks you would call friend – both those who sell patterns and those who offer them for free to users for the benefits they bring to thier personal websites.

Frankly all the financial bailouts in the world won’t matter if they thoughtlessly put you out of business by allowing big business (Getty, Corvus, and Google) the opportunity to screw it up a pattern author’s property rights as they have allowed banks & financial institutions to do thus far.

Congress is being LIED to by the Chair of the Copyright division and you need to let them know this matters – ONLY two organizations who lobbyist have other loyalties have been consulted.

Last but not least, you need to make sure they understand you vote and will remember all who did not OPPOSE this bill – including those who “just let it happen” by not actively opposing it.

Orphan Works Oppostion, WHY we need your help NOW

Hi Everyone,

Bad news… Conyers, Berman and the House leadership are in active discussions to pass the House bill NOW. We had a scare earlier tonight when we thought that the bill would be put on the suspension calendar this evening (which means it would be voted on), but now it looks as though it will be tomorrow morning unless we can do something to prevent it!

After consulting with Brad Holland, Cynthia Turner and the other team leaders, here’s the strategy:

We need to get to Speaker of the House Nancy Pelosi and House Majority Leader Steny Hoyer and
ask them NOT to allow H.R. 5889 to go on the calendar.

We also need to get to 4 critical members of the House Judiciary Committee and tell them NOT to
abandon their version of the bill and accept the Senate version.

This is SO important that we are asking everyone to phone, fax AND e-mail these six people
IMMEDIATELY. Perhaps if they all get 10,000+ messages in the next 24 hours it will have an impact.

Here is the contact information, followed by sample letters that you may use as is, or edit as you see fit. Please be aware that some of the representatives only accept e-mails from constituents.

If you have trouble getting through on their individual lines, you can also CALL CONGRESS:
1-800-828-0498. Tell the U.S. Capitol Switchboard

Operator “I would like to leave a message for Congressperson __________ that I oppose the
Orphan Works Act.” They will switch you through to the lawmaker’s office and often take a message
which also gets passed on to the lawmaker. Once you’re put through give the same message.

What OWOH Needs You To Do NOW Letter 2

Dear Rep. (Conyers, Delahunt, Nadler, Berman),

Please, please, help me. For months I have been
contacting members of Congress regarding my
opposition to H.R. 5889, the Orphan Works Act of
2008. This legislation, if passed as written,
will have devastating consequences for millions
of copyright holders. On Friday, the Senate
passed their version of the Orphan Works bill,
and my worst fears will be realized if the House follows suit.

I am totally outraged that now­


… when we were led to believe that the bill would
not be passed by the 110th Congress… NOW is when
Congress is trying to re-write our copyright laws.

I am part of a loosely formed alliance of 75
organizations representing over 500,000 artists,
photographers, musicians and writers­AND WE WANT
OUR VOICES HEARD. Please do NOT allow this bill
to pass now­ and do NOT adopt the Senate version
of the bill. This radical change to copyright law
is not in the best interests of our
country­especially given the economic crisis we
are facing. In the upcoming election this will be
a vote-deciding issue for me and many artists
like me. We want to have a voice in crafting
appropriate Orphan Works legislation which will
not devastate multiple industries, and despite
what you may have been told we have not been
given that opportunity. Please help us make that happen­in the 111th Congress.

Join Us In Washington

Did you miss out on the 60’s?

Haven’t you ALWAYS wanted to say that you went to Washington to fight for your rights???

Here’s your chance to make a difference!!!


We’ll be meeting Wednesday and Thursday mornings at 8:30 a.m. at the Harte Senate building in the ground floor cafeteria, right hand side near the glass windows when you walk in.

Also, we plan on assigning someone to sit there for the day to help direct people to their appointments, pass out our literature, etc. We could use a volunteer for this, too.

If anyone lives in the area, even if you can come for one day, we invite you to join us. If you don’t want to talk, that’s ok, just being there will help reinforce our position. The more, the better!

Note, we want to look as professional as possible so please keep this in mind. (We will be in business attire)

Bring along some printouts of your art to share with the Senators and Congressmen! Or your kid’s art!

Let them see what’s at risk. Have you been infringed? Share your story on a flyer. It’s the personal aspect of this that will get their attention.

When they see that we’ve gone to the extreme of leaving our studios to come to Washington, they’ll know we are committed to our cause.
